S pecial ju dge to hear Skinner ca se

A specially appointed judge will preside over the election challenge recently filed by write-in sheriff candidate Gus Skinner.

Skinner, represented by Corbin attorney Darrell Saunders, filed a petition last week contesting the November Election primarily on the basis of first name only, or “GUS” votes should count. Skinner was named sheriff on election night with 1659 votes over Randy Waters. After a recanvass following the election, discrepancies in the counting of write-in votes dropped Skinner’s vote total to 1626. Waters’ total remained at 1636 and he was certified as Sheriff-Elect of McCreary County.

The case will be heard in Circuit Court. McCreary County Circuit Court Judge Paul Braden, of Woodbine, dismissed himself from the case on Friday and requested a judge be appointed in his place. David Tapp, the 28th Circuit Court Judge (Somerset), was assigned to the case.

The McCreary County Fiscal Court, along with County Attorney Phil Chaney also addressed the petition Tuesday during an executive session. The court is indirectly involved because of County Clerk Jo Kidd and the court’s appointment of the Board of Elections. McCreary County Judge-Executive said Wednesday Chaney was authorized to retain legal counsel for the election board.

Chaney and state officials from the Attorney General’s office advised Kidd and the election officers not to count the first name only votes when computing election returns.

The petition filed against the board with the McCreary County Circuit Court Clerk states those votes with first name only do show voter intent and should be counted. More than 50 of those votes, more than enough to give Skinner the election, were disregarded on election night and during the recanvass. The McCreary County Board of Elections, who are named respondents to Skinner’s suit, were advised by the state Attorney General’s office not to count those votes.

Skinner’s petition also challenges the legality of the recanvass and questioned a 20-vote discrepancy in “E-Slate” vote totals from election night to the recanvass. The primary argument though remains with the first name votes. The petition states there was only one write-in candidate seeking the office of Sheriff, and, furthermore, only one candidate named “GUS.” Votes containing only the first name should be enough to show voter intent, the petition Skinner says. He added that he has 38 registered voters, who voted in the General Election, who have come forward indicating they voted by writing in only his first name, but that act was based on their intent to vote for “Gus Skinner for Sheriff.”

Skinner’s petition was filed on December 6. Reportedly, those named in the petition, the Board of Elections, Milford Creekmore II and Randy Waters have 20 days to offer a response. State law stipulates the case take precedence, where practical, over other court matters and should be “fast-tracked.”

The next Sheriff is supposed to take office at midnight on December 31.

Skinner is asking the results of the General Election be set aside, along with Waters’ status as Sheriff-Elect, and that the court adjudge him McCreary County Sheriff. Waters could possibly take office even with the challenge presented.

Saunders will take some depositions in the case on Friday. A hearing date has not yet been set in the case.


Duncan will fill COMDEV post

Tim Duncan will fill the “revamped” position of Community Development Director beginning Monday.

The local banker was considered the top choice by the McCreary County Industrial Authority for the position. The job will reportedly grow to being a full-blown economic development position for McCreary County focusing on all angles of industrial and business development. The McCreary County Fiscal Court officially approved Duncan’s hiring on Tuesday. McCreary County Judge Phillips made the recommendation, which received unanimous approval from the magistrates.

Duncan has various banking experience, apparently a strong quality for his consideration for the job. Duncan recently informed the Bank of McCreary County, his current employer, that he would be taking the job if the court granted approval.

“ This is an exciting opportunity for myself and I feel I can succeed in promoting growth and developing the economy of McCreary County,” Duncan said.

Not only will Duncan work to recruit potential employers for the county, he will take over where former COMDEV Director Patrick Thrush left off in administering the county’s revolving loan fund. The county utilizes state and federal dollars to encourage the local development of small businesses.

Judge Phillips has said the revolving loan portion of the job will necessitate about 20 percent of the director’s time, but the majority of the work will be working closely with the Industrial Authority in recruiting business. Duncan will be paid and his office financed primarily with occupational tax funds derived from a 20 percent allocation for economic development.

Duncan was one of eleven applicants for the position and one of four interviewed for the job. He and one other individual seeking the position were recommended to the Fiscal Court for hiring. The Industrial Authority named Duncan as their top choice.

“(Duncan) is clearly the top choice because of his banking background, local knowledge, friends with local and state leaders, roots in the county and has shown a clear desire to see this county grow by his past actions and commitment of his time to help grow the county,” Industrial Authority Chairman Rick Stephens said in a letter to Judge Phillips, which was read during Tuesday’s Fiscal Court meeting.

Not only has Duncan served as a member of the local banking community, he has also served in various capacities, including President, for the Chamber of Commerce and is active in other organizations such as the McCreary County Tourism Commission.

Industrial Authority directors outlined a 20-point plan that Duncan, as new Director of Economic Development, is expected to fulfill. Some of those points include building relationships with local, state and federal leaders and economic development groups; creating a county economic development and marketing plan; promoting and working to expand local businesses and must set a target to develop 100 new jobs per year for the next three years.

“I am up to it and think that things can happen for McCreary County,” Duncan said. “I’m going looking for businesses as soon as I get in that office and don’t plan on waiting for them to come to us. Even if a business is not looking for something else, I am going to go to them and tell them what we have to offer.”

Ralph Chaney, age 83 years, 9 months, and 29 days, of Pine Knot, Kentucky passed away Wednesday, December 13, 2006 at his home.


Celebration of Life Services were held on Saturday, December 16, 2006 at 11:30 a.m. at the First Christian Church in Pine Knot, Kentucky with Bro. Clyde Arnold and Bro. Greg Owens officiating. Burial of cremains followed with full military honors. The following served as honorary pallbearers, Dr. Jim Anderson, Jim Hayes, Howard Washam, Dean King, Doug Shelton, Dan Hisle, William “Doc” Coffey, Danny Strunk, and Doug Strunk.

He was born February 15, 1923 in Whitley City, Kentucky to Arthur L. Chaney and Violet Roder Chaney. Ralph served in the U.S. Army from 1939 to 1945 during World War II. He was the youngest master sergeant in the army during the war. He retired after 37 years of service with United States Post Office, having served at postmaster at the Pine Knot Post Office. Ralph was a founding member of the Pine Knot First Christian Church and in 1954 started little league baseball in Pine Knot. He was a pillar of the community and served in various positions to help advance our community. He enjoyed sports, hunting, fishing, U.K. football games, and spending time with his family.

Preceding him in death were his parents, his wife, Jean Chitwood Chaney, whom he married on February 21, 1945, a son-in-law, Jerry M. King, and a brother, Lloyd Leroy Chaney who was killed in WWII.

Survivors include three sons, Mike Chaney and his wife, Jan, of Pine Knot, Kentucky, Dean Chaney and his wife, June, of Pine Knot, and Phillip Chaney and his wife, Judy, of Stearns, Kentucky, a daughter, Linda King, of Pine Knot, a brother, Ernest “Dutch” Chaney and his wife, Darlis, of Pine Knot, nine grandchildren, and six great grandchildren.

Vela Childe, age 75 years, 4 months, and 14 days, of Whitley City, Kentucky passed away Saturday, December 9, 2006 at the McCreary County Health & Rehab Center in Pine Knot, Kentucky.


Celebration of Life Services were held on Sunday, December 17, 2006 at 10:30 a.m. at the McCreary Health and Rehab Center in Pine Knot, Kentucky with Bro. Hap Strunk officiating. In accordance with Ms. Childes wishes her remains were cremated.

She was born July 26, 1931 in Whitley City, Kentucky to Willie Vanover and Bessie Bryant. Before her retirement she was an antique dealer and she owned a business in Lockland.

Preceding her in death were her parents, a son, Wayne Malone, and a sister, Verna Bargressa.

Survivors include six children, Randall Malone, of Cincinnati, Ohio, Linda Sue Malone Flaherty, of Mesa, Arizona, Stan Malone, of Apache Junction, Arizona, William “Billy” Privett, of Tampa, Florida, Tracy Patton, of Campellsurg, Indiana, and John Childe, of Cinncinnati, Ohio, a brother, Sonny Vanover, of Whitley City, Kentucky, four sisters, Beatrice Claxton, of Whitley City, Hazel Poole, of Pulaski County, Kentucky, Thressa Davidson, of Whitley City, and Betty, of California, eight grandchildren, and nine great grandchildren.

Walter A. Cotterman

Walter A. Cotterman, age 75, of Sidney, Ohio passed away Friday, December 8, 2006 at 2:35 a.m. at Wilson Memorial Hospital.


He was born on August 1, 1931 in Sidney, Ohio to Walter Cotterman and Mildred Small Cotterman. On November 30, 1957 he married Nina K. Jones.

He is survived by his wife, Nine Jones, of Sidney, Ohio, a daughter, Mrs. Daniel (Cynthia) Ryan, of Sidney, Ohio, and two sisters, Mrs. Lloyd (Nancy) Wilford and Mrs. Larry (Jimmie) Wilford, all of Sidney, Ohio.

Four sisters and one brother preceded him in death.

Walter was a U.S. Army Korean Veteran and a member of The Sidney American Legion Post 217. Mr. Cotterman was a machinist for the Copeland Corp., and he retired in 1993 after 20 years of service. He was a member of the Faith Baptist Church of Sidney.

Funeral services were held on Monday, December 11, 2006 at 10:30 a.m. at the Cromes Funeral Home in Sidney, Ohio with Bro. Chad Inman officiating. Burial followed in the Graceland Cemetery.

Albert Oscar Huff, Jr., age 49 years, 4 months, and 13 days, of Stearns, Kentucky, passed away Monday, December 18, 2006 at his home.

In accordance with Mr. Huff’s wishes his remains will be cremated.

He was born August 5, 1957 in St. Petersburg, Florida to Albert Oscar Huff, Sr., and Agnes Beebe. He was employed at the Job Corps Center as an Urban Forestry Instructor. He moved here from St. Petersburg, Florida on April 20, 2006. He enjoyed motorcycling, eagle watching, and Native American studies.

Preceding him in death was his father, Albert Oscar Huff, Sr.

Survivors include his companion, Kathy Reed, of Stearns, Kentucky, a son, Sean Huff, of Stearns, two daughters, Samantha Huff, of Stearns, and Joy Vach, of St. Petersburg, Florida, his mother, Agnes Beebe, and St. Petersburg, and two sisters, Wanda Robinette, of St. Petersburg, and Glorida Weidman, of Colonial Heights, Virginia.

Paul Ross, age 33 years and 10 months, of Revelo, Kentucky passed away Sunday, December 17, 2006 in an automobile accident.

Funeral services were held on Wednesday, December 20, 2006 at 1:00 p.m. at the Hickman-Strunk Funeral Home with Bro. Mike Casada and Bro. Stanley Taylor officiating. Burial followed in the Stearns Cemetery with the following serving as pallbearers, Clayton Shoopman, Dave Ball, William King, Christopher Wallen, P.J. Ross, and Michael Boyatt.

He was born February 17, 1973 in Keene, New Hampshire to Phillip Ross and Frances Benoit Ross. He was a member of the Marshes Siding Church of God and was employed at the Outdoor Venture Cooperation. He enjoyed 4-wheeling, and loved his girls and his family.

Survivors include his parents, Phillip Ross, of Oneida, Tennessee and Frances Ross, of Revelo, Kentucky, two daughters, Brooklyn Nicole Ross and Brittany Paige Ross, two brothers, Patrick Ross, of Louisville, Kentucky and Phillip Chase Ross, of Oneida, Tennessee, two sisters, Teresa Wallen and her husband, Larry, of Revelo, Kentucky, and Deborah Villarreal and her husband, Thomas, of Dallas, Texas, two nephews, P.J. Ross and Christopher Wallen, and a great nephew, Bryson Wallen.
