Taxing issue confronts PVA

Tax bills will be issued this year despite public concern to the contrary, says Bruce Lominac, McCreary County PVA.

As the time nears for issuance of the 2007 property tax bills, topical discussion around the county would lead one to believe that the year will pass without a tax bill in the mailbox. Lominac told members of the local media Friday, however, tax bills will be issued later than he would like, but they will be issued this year.

According to state law, Lominac, along with every other PVA in the state, are to finalize annual assessments in April, open tax rolls for public inspection in May and assist in the preparation of tax bills no later than September. Lominac said he is awaiting certification of his 2007 assessment from the state, filed an extension in the process and hopes to get tax bills out in November.

“When we took office, very few deeds for 2006 had been processed,” Lominac said noting the 2006 items must be finalized before assessments for 2007 could begin. “A lot had to be done before the new tax roll could be issued and it was difficult to get the cart in front of the horse.”

Lominac, who took office in December after election as PVA in November, said another issue arose when the sales ratio did not meet state requirements. State law requires the actual or potential sale value for a piece of property in a given year to be within a certain percentage of the recorded assessment. State officials are working with him now to review 2006 records and to meet that sales ratio.

All of this, Lominac said, coupled with regular duties of reassessing property (State law requires this to occur each year with physical re-evaluation every four years, even though, he noted, some property has not been re-assessed according to the state schedule. By the end of his term, every piece of property in the county should be physically re-evaluated for assessment.), has put his office and the 2007 tax bills behind schedule.

“My staff has been working in the office processing the 2006 deeds while I have been out reassessing property,” Lominac said. “We are doing everything we can to beat the time frame from last year and hopefully with all the work and improvements we are doing now, bills can come out even earlier next year.”

Lominac said state law sets a September 15 issuance date each year for tax bills, but it is not unusual for Property Valuation Administrators to request an extension in the process or for bills to reach citizens at a later date.

The possible tardiness within the issue is putting many other local officials on alert, especially those that depend on property taxes to run their office. The issue was a hot item of discussion Tuesday morning before, during and after the Fiscal Court meeting.

“The tax rolls still have to be opened for public view and have a period of time to appeal,” Magistrate Roger Phillips said. “It will prolong everything.”

“Are we going to have two tax bills next year,” asked Magistrate Judy Redden. “This could make it hard on all the county entities that depend on tax money.”

County officials, including the members of the fiscal court, school board, library board, fire departments, etc., must wait on the finalization of the current year assessment before they can affix the 2007 tax rates. State law stipulates increases and decreases in tax rates, based on the amount of increase in annual assessments.

Lominac said the assessment for 2007 has increased by $12 million to around $312 million in taxable real property. He said he is waiting on Frankfort officials to review 2006 property sales and the stipulated sales ratio. Once that is complete, the 2007 assessment can be sent to Frankfort for approval, open for public review and then forwarded to county officials to affix a tax rate. From that point, tax bills can be issued. This process should begin within the next few days, Lominac added.

“It will take two runs through the tax rolls, this year and next, to get things to the standards they should be,” Lominac said. “I was hoping to do it in one, but I just can’t. But, don’t panic, there will be a tax bill this year.”

31 indicted, eight in UNITE cases

Investigators with Operation UNITE obtained felony indictments against eight individuals this month on various drug charges, including three people accused of selling marijuana within 1,000 yards of a local school.

Last week, a McCreary County Grand Jury returned 24 indictments against 31 different individuals.

In one of the UNITE cases, detectives obtained an indictment against Daphene Corder, 27, Dorsey Clark, 29 and Steve Rollins, 42, for trafficking in a controlled substance within 1,000 yards of a school. The indictment says that on July 14, 2005, the three allegedly sold a confidential informant one pound of marijuana for $1,600 at a location within 1,000 yards of a school.

Corder and Clark were named in a separate indictment on charges of trafficking within 1,000 yards of a school for an incident that allegedly occurred on July 8, 2005. The indictment states the pair sold a confidential informant 18.2 grams of marijuana for the sum of $140 at a location within 1,000 yards of a school.

In other UNITE cases:

• Joe Vanover, 46, was indicted last week and faces a charge of first-degree trafficking in a controlled substance for allegedly selling a confidential informant two Oxycontin for the sum of $60 on May 8, 2007.

• Robin Gregory, 35, faces charges in a four count indictment based on evidence presented to the grand jury by UNITE officials. The indictment brought two counts of first-degree trafficking in a controlled substance against Gregory, after allegedly possessing for sale Percocet and Oxycontin to an informant; one count of second-degree trafficking for possession for sale of 125 Hydrocodone and one count of third-degree trafficking for possessing for sale 33 Clonazepan.

• Charles Smith, 38, faces a charge of first-degree trafficking in a controlled substance after allegedly selling a confidential informant half of an Oxycontin in November 2006.

• Linda Baird, 44, faces charges of first-degree trafficking in a controlled substance and second-degree trafficking in a controlled substance after allegedly selling an informant methamphetamine on November2, 2006 and Hydrocodone on November 14.

• David Jones, 42, was indicted on a charge of second-degree trafficking in a controlled substance after he was allegedly found in possession of 19 Hydrocodone.
Among other indictments:

• Lenzee Cox, 24, Deborah Cox, 29 and Vernon Duane Cross, 36 were named in a 22 count indictment charging the three individuals with multiple counts of fraudulent use of a credit card.

• Lenzee Cox was also named in a separate indictment along with Adam Meadows, 26, that charges each on one count of first-degree possession of a controlled substance and possession of drug paraphernalia. According to the indictment, Kentucky State Police Trooper C.A. Dingess found the pair in possession of Oxycodone, a spoon and a burnt soda can on April 24, 2007.

• Cox was named in a third indictment this month relative to an incident that occurred on July 4, 2007 when she allegedly broke into the home of Debbie Cox and stole various items. In this case, Cox faces charges of second-degree burglary and theft by unlawful taking over $300.

• Esler Neal, 30, faces a charge of theft by unlawful taking over $300 after allegedly taking an air compressor belonging to James Neal.

• Nathan Hurd was indicted on charges of second-degree assault and being a persistent felony offender. The indictment says Hurd, 21, wrecked a vehicle, while driving under the influence, on April 1, 2007 causing serious injury to a passenger in his vehicle.

• Harvey Madden, Johnny Bruce Marion and Diane Patricia Tucker were all named in an indictment last week. Madden, 36, and Marion, 45, each face a charge of second-degree escape and being persistent felony offenders after they allegedly escaped from the custody of the McCreary County Jail while on work release on June 1, 2007. Tucker, 47, faces a charge of complicity to second-degree escape for allegedly assisting Madden and Marion in the escape.

• Veine Boggs, 21, faces a charge of first-degree promotion of contraband for allegedly bringing marijuana and Hydrocodone into the jail on March 30, 2007.

• Donnie Jason Lair, 27, faces a charge of first-degree fleeing or evading police for an incident that allegedly occurred on May 29, 2007 when he disobeyed an order to stop his vehicle, while fleeing from Deputy Chris King.

• Archie L. Stevens, 57, faces two counts of receiving stolen property over $300 after allegedly being found in possession of two four-wheelers, one stolen from Roscoe Spradlin and one stolen from Larry Cordell.

• James R. Creekmore, Jr., 25, faces charges of first-degree fleeing or evading police and being a persistent felony offender for allegedly fleeing in his vehicle from Deputy Joe Horne on May 1, 2007.

• Bridget Watters, 24, and Gerald Ball, 42, were jointly named in an indictment charging them with first-degree possession of a controlled substance and possession of drug paraphernalia.

• Roscoe Garland, 38, faces a count of fourth offense DUI after allegedly operating a motor vehicle under the influence of alcohol on June 2, 2007.
• Christopher Bryant, 32, and Kenneth D. Shook, 53, were named together in an indictment and each face a charge of first-degree possession of a controlled substance, specifically cocaine, which they were allegedly found in possession of by KSP Trooper Jason Browning on March 11, 2006.

• Brandon Miller, 27, faces a charge of first-degree possession of controlled substance, specifically Oxycodone, after allegedly being found in possession of Oxycodone by KSP Trooper Browning on August 12, 2005.

• Larry Foster Jr., 27 and Crystal L. Barnett, 29, each face a count of first-degree possession of a controlled substance after allegedly being found on possession of Oxycodone on July 17, 2005. Foster also faces a charge of being a persistent felony offender.

• Tommy Hughes, 24, faces charges of first-degree robbery and being a persistent felony offender for an alleged armed robbery of the Marshes Corner Market on June 10, 2007.

• Jim Murphy, 41, faces three different counts after an indictment was returned in a case against him last week. Murphy faces charges of first-degree unlawful transaction with a minor, first-degree promotion of contraband and first-degree trafficking in a controlled substance.

Martha Slaven King

Martha Slaven King, age 72 years, Whitley City, Kentucky died August 3, 2007 at McCreary County Health Care, Pine Knot, Kentucky. Funeral services were held Tuesday, August 8, 2007 at McCreary County Funeral Home with Rev. Ronald Duncan and Rev. Davis Troxell officiating. Burial was in Josh Wilson Cemetery.

She was born at Stearns, Kentucky on October 17, 1934 the daughter of the late Ezra and Dora King Slaven. She was a homemaker and of the Baptist faith.

Her parents precede her in death. The deceased sisters are, Flora Tabitha Slaven; Vela Agnes Slaven; Lorene Slaven and Theda Louise Slaven.

Survivors include her children, Wayne King; James Curtis King, Jr., Monticello, Kentucky; Jeffrey Allen King, Frankfort, Kentucky and Kathy King, Smyrna, Georgia. The surviving brother and sisters are, Lenville E. Slaven, Louisville, Kentucky; Edna Bernice Daugherty, Strunk, Kentucky; Arlene Chitwood; Betty Jean Dixon, Pine Knot, Kentucky and Joyce Thompson, Cincinnati, Ohio. Eight grandchildren and four great grandchildren survive.

Erica Dawn Corder

Erica Dawn Corder, age 29 of Sommersville, Ohio, formerly of McCreary County died Sunday August 5, 2007 at McCullough-Hyde Hospital in Oxford, Ohio.

Graveside funeral services were held on Wensday August 8, 2007 at 5:30pm at the Barren Fork Cemetary, with Bro. Leslie Gilreath and Bro. Jason Kates officiating.
She was born in Somerset, Ky on February 21, 1978 to the late Charlotte Johnson and Jerry Lynch of Beulah Heights.

In addition to her mother, she is preceded in death by her grandparents, James I. and Dorothy M. Troxell Davis.

Survivors include her father, Jerry Lynch and his wife Lela of Beulah Heights, and her step father, Cuthbert “Bert” Johnson, of Sommerville, Ohio. Her children, Stormy Corder, Austin Corder and Harley Roundtree all of Stearns. There are 2 brothers, Justin Lynch of Beulah Heights and Tim Davis and his wife Genell of Marshes Siding, and 2 sisters, Maggie Lynch of Beulah Heights and Amy Johnson of Sommerville, Ohio. Her paternal grandparents Ruthel and Maggie Lynch of Parkers Lake.

There are many aunts, uncles, and cousins also surviving.

Evelyn Perkins

Evelyn Perkins, age 79, of Morrow, Ohio, passed away Thursday, August 9, 2007.

Funeral services were held Monday, August 13, 2007 at 8:00 p.m. at the Tufts Schildmeyer Funeral Home, 129 Riverside Drive, Loveland, Ohio. Graveside funeral services were held Tuesday at 2:00 p.m. at the Bethel Cemetery in Pine Knot, Kentucky.

Mrs. Perkins was the beloved wife of the late Fred Perkins, step-daughter of Nettie Ball of Maineville, Ohio, loving mother of Edward Perkins (late Laura) of Lebanon, Ohio, Betty Brown (David) of Westmoreland, Tennessee, Teressa Abt (Richard) of Morrow, Ohio, and Gayle Shelton (Richard) of Williamsburg, Ohio, and the late Freddie Perkins. She was the sister of Elmer Ball, Christine Sevier, Josephine King, Ernestine Lewis, Ronald Ball, the late Aileen Hornsby, the late Andrew Ball, the late Ray Ball and the late Kenneth Ball. She was the grandmother of Neal Perkins, Stacy Baugh, Patricia Baker, Angela Baker, Ami McDonald, Rebecca Walker, Michael Abt, Mark Shelton, Carrie Shelton, David Brown and Greg Brown. She was the great grandmother of 15 great grandchildren.

Randall Ray Smith

Randall Ray Smith, age 63 years, Stearns, Kentucky died August 10, 2007. Funeral services were held Sunday, August 12, 2007 at McCreary County Funeral Home with Rev. Israel Clark officiating. Burial was in Sherd Dobbs Cemetery.

He was born at Yamacraw, Kentucky on January 23, 1944 the son of the late William A. and Hazel Bell Smith. He was a coal miner and member of Lower Wolf Creek Baptist Church. He served in the U. S. Army. He was a member of American Legion and the VFW.

His son, Randy Coffey and his parents precede him in death. The deceased brothers are Wendell Smith and Arnold Smith.

Survivors include his children, Bobby Smith and Debbie Smith, Stearns, Kentucky. The surviving brothers and sisters are, Robert Smith, Monticello, Kentucky; Dwight Smith, Texas; Roy Smith, Plattsburg, New York; Freddie Smith; Orangie Hickman, Harrison, Ohio and Anita DeVary, Magnolia, New Jersey. Two grandchildren survive.

Maggie Lynch

Maggie Lynch, age 82 years, Parkers Lake, Kentucky died August 10, 2007 at McCreary Health Care, Pine Knot, Kentucky. Funeral services were held Sunday, August 13, 2007 at Indian Creek United Baptist Church with Rev. Larry Vanover and Rev. Bill Patrick officiating. Burial was in Higginbotham Cemetery.

She was born at Flat Rock, Kentucky on May 9, 1925 the daughter of the late Jackie and Lily Perry Bryant. She was retired from Cumberland Falls State Park. She was a member of Indian Creek United Baptist Church.

Her son, Fletcher Lynch and her parents precede her in death. The deceased brothers are, Dewey Bryant; Mart Bryant; Arnold Bryant; Lonzo Bryant; Maynard Bryant; Artman Bryant; Roscoe Shelley and Homer Bryant. Three grandchildren, Whitney; Matthew and Erica Lynch are deceased. Bob Whittle is deceased son-in-law.

Survivors include her husband, Rev. Ruthel Lynch and her children, Wesley Lynch; Gary Lynch and wife, Kim; Louise Lynch; Eddie Lynch; Rema Perry and husband, Lloyd, Parkers Lake, Kentucky; Stanley Lynch and wife, Tilda; Jerry Lynch and wife, Lela, Whitley City, Kentucky; Virginia Barnett and husband, Carl, Oak Ridge, Tennessee and Geneva Whittle, Gallatin, Tennessee. Gladys Bruce, Lily, Kentucky is the surviving sister. Fifteen grandchildren and twenty great grandchildren survive.

Kearney L. Anderson

Kearney L. Anderson, Sr., age 61 years, Revelo, Kentucky died August 12, 2007 at Lake Cumberland Regional Hospital, Somerset, Kentucky. Funeral services were held Wednesday, August 15, 2007 at McCreary County Funeral Home with Rev. David Troxell officiating. Burial was in Pleasant Run Cemetery.

He was born at Oneida, Tennessee on December 14, 1945 the son of the late Walter Henry and Amanda Wilson Anderson. He was a barber and member of Sons of Legion. Several years ago he accepted Jesus Christ as his savior and was baptized.
His parents and stepdaughter, Tammy Bartley preceded him in death. Finley Anderson is the deceased brother.

Survivors include his wife, Sharon Vestal Anderson and his sons, Kearney Anderson, Jr., Revelo, Kentucky and Andy Anderson, Pine Knot, Kentucky. The surviving stepson is Eddie Bartley and wife, Nicole, Marshes Siding, Kentucky. Four grandchildren survive, Brandi Stephens; Carlee Lowery; Joshua Bartley and Gabriel Anderson. An aunt, Margaret Strunk and a niece, Vanessa Anderson, survive him. His friends at Lifeline Home Health and McCreary Ambulance Service also survive him.
